The DfE’s new statutory guidance (February 2015) provides further clarification on which staff are covered by the 2009 legislation.
Section 6 describes the coverage for staff who occasionally work with children in this age group, including those involved in healthcare provision.
Section 9 states specifically that ‘staff such as caretakers, cleaners, drivers, transport escorts, catering and office staff, who are not employed to directly provide childcare, are not covered by the legislation’.
The guidance also contains tables describing all the ‘relevant offences’ and orders that lead to disqualification including ‘by association’.
