Subject Access Request (SAR) challenge
This breakfast briefing will lead you through the difficult task of successfully dealing with a SAR. As you may be aware, one of the key aims of the Data Protection legislation is to empower individuals and give them control over their personal information. The right of an individual to be given a copy of their personal data is known as a Subject Access Request ("SAR"). Sometimes it is difficult to actually identify a SAR. Therefore it is important to ensure all staff can recognise a SAR and deal with it appropriately.
We are seeing a huge increase in the number of SARs received by schools from parents on behalf of their child and/or from a member of staff. Typically most Subject Access Requests result from acrimonious and difficult situations which makes their receipt an additional burden for the school.
There are strict time limits to follow and a thorough procedure followed by competent staff is highly recommended as there may be serious consequences if the school fails to comply with a SAR properly.
